Just one day after the prosecution and convicted rapist Stephen Clayton of Kingston agreed to a plea deal, another victim came forward with the hope of forcing a separate trial.
Now the fourth victim to file a report against Clayton, the 27-year-old Bremerton woman said she had previously come to terms with her encounter and moved on, but the circumstances surrounding the trial motivated her to come forward.
“I never reported my incident because I blamed myself for what happened,” she said. “I put myself into a … situation and didn’t feel like I had a leg to stand on, but after hearing about his repeated predatory behavior, I wanted to add another story of similar behavior to that.”
Clayton pled guilty Dec. 19 to one count of rape and one count of assault after previously facing three counts of rape. The prosecution reported that it was not confident in its case, and there was a strong chance of Clayton walking away free with a plea agreement.
The plea deal received major criticism from two of the three victims, along with other community members, for eliminating one of the victims from any feeling of recognition. It was that “injustice” that motivated Victim 4 to file her police report Dec. 20.
“Even if I can’t make my own case, I want to get involved now because it sounded like three women had come forward…and he was getting charged for one rape for the price of three,” she said.
Police reports indicate the latest alleged rape occurred in the summer of 2012, when she was just 17 years old. She and two friends met up with boys from North Kitsap High School at Island Lake County Park. They brought alcohol that she and others consumed. Her two friends and one of the boys left, leaving her with “Shark,” who ended up being Clayton, and another man.
They continued to drink, causing her to pass out. She later woke up to Clayton allegedly raping her and the other man watching. She says in the report she did not resist for fear of retaliation from both men.
The report also indicates that she and Clayton’s girlfriend and later wife worked together at a Taco Time for two years after the alleged rape took place. During that time, she said she did not disclose the incident, as she and Clayton seemed happy together, also noting later that Clayton seemed to have matured.
“To see that report now that his behavior has continued, it’s kind of frustrating to say that in the gentlest way possible,” she said.
While this part of her life was tucked away for over 10 years, Victim 4 said she felt a sober voice was needed in the continued fight against Clayton. “I pay my taxes. I am an upright citizen. I have a good job, and if they need that in order to prosecute for sexual abuse and sexual assault, then I’d like to provide that.”
One of the other victims is contacting law enforcement in other states. She is concerned that as a long-haul truck driver, Clayton could have other victims elsewhere.
