Port Orchard is in the process of updating its Critical Areas Ordinance as part of the ongoing 2024 Comprehensive Plan update.
The proposed amendments, designed to ensure compliance with the state’s Growth Management Act, were outlined in a presentation prepared by Community Development director Nick Bond and presented by senior planner Jim Fisk.
The update aims to protect critical areas within the city, such as wetlands, wildlife habitats and geologically hazardous zones. Under the GMA, all cities and counties are required to adopt and periodically update regulations to safeguard those areas.
The amendments integrate best science for protection of critical areas in the city, Fisk said, adding they also aim to balance environmental protection with development needs..
The proposals include updates to bring the law in line with state and federal requirements, while also improving its clarity and usability. The amendments focus on reorganizing sections of the ordinance, updating wetland buffer standards and aligning terminology with state agencies. Other revisions include prioritizing mitigation banking and programmatic solutions for wetland mitigation, as well as enhancing Riparian Management Zone standards to provide greater protection for critical habitats.
The city has created a webpage dedicated to the CAO, which includes ways for the public to get involved. A comment matrix will track feedback, showing how comments are addressed and whether they result in changes to the proposals. This will be shared with the Planning Commission and public to ensure transparency.
The commission discussed the proposed amendments Feb. 4, followed by a public hearing in March. The commission is expected to make a recommendation that will be presented to the City Council for consideration in the spring.
Mayor Rob Putaannsuu highlighted the importance of the CAO as part of the larger planning effort, noting that the Comprehensive Plan provides the long-term framework for the city’s growth, while the updated laws help implement those goals.
